Terms of Service

1. Agreement
These Terms are a binding agreement between you (or the entity you represent) and AutomatticCRM, Inc. ("AutomatticCRM", "we"). By creating an account or using the Service, you agree to them. If you don't, don't use the Service.
2. The Service
We provide a hosted customer relationship management platform. Features, limits, and pricing are described on the pricing page and in your order form. We may change the Service, but we won't materially reduce a feature of a paid plan during a paid billing cycle without offering you a prorated refund.
3. Accounts
You're responsible for keeping your credentials secure, for all activity under your account, and for ensuring your team members comply with these Terms. You must be 16 or older. Accounts under fraudulent names or obvious bot traffic will be terminated without refund.
4. Your data
You own your customer data. We don't use it for advertising, don't sell it, and don't train public models on it. You grant us a limited license to store, process, and display it as necessary to provide the Service. On termination, we'll make a full export available for 60 days, then purge.
5. Acceptable use
Don't use the Service to send spam, phish, harass, distribute malware, infringe IP, or violate applicable law. Don't attempt to breach our security, scrape bulk data, or reverse-engineer the Service beyond what's allowed by law. We reserve the right to suspend accounts engaged in abuse.
6. AI features
AI-generated content may be inaccurate. You're responsible for reviewing AI output before using it externally — particularly for legal, financial, or medical decisions. AI credits are consumable and non-refundable once used.
7. Fees & billing
Paid plans auto-renew at the end of each term unless canceled. Fees are non-refundable except where required by law or explicitly stated. We may change list prices with 30 days' notice; existing subscriptions are grandfathered through the current term.
8. Term & termination
Either party may terminate for material breach uncured for 30 days. We may terminate immediately for violations of Section 5, non-payment after 15 days, or if required by law. You can cancel anytime from billing settings; cancellation takes effect at the end of the current term.
9. Warranties & disclaimers
The Service is provided "as is" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted or error-free, though our published uptime SLA applies to Pro and Enterprise plans.
10. Liability
Our aggregate liability is capped at the greater of $100 or the fees you paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages. Some jurisdictions don't allow these limits — in which case they apply to the maximum extent permitted.
11. Indemnity
You'll indemnify us against claims arising from your customer data or your use of the Service in violation of these Terms. We'll indemnify you against third-party claims that the Service infringes their IP, subject to standard carve-outs.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Disputes will be resolved in the state or federal courts of Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.
13. Changes
We may update these Terms. We'll email account admins at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
